As a sign of good faith, fair dealing and a commitment to change - Settle the long standing Oregon Civil Rights case of disabled pro se Kevin Hayes vs Wal-Mart. Reinstate Kevin Hayes, restore his reputation, and justly compensate him for the injustice, pain, and suffering that W/M has needlessly put him and his entire family through. What happened to Kevin Hayes, and is continuing to happen to W/M workers is unconscionable. Respect your workers and stop wasting millions of dollars fighting to suppress civil rights. Instead utilize those resources to improve the lives of W/M workers so they too can "live better"

The Wal-Mart Way, it's lies & deception, illegal & unethical behavior, and W/M's vast resources are making a mockery of our civil rights laws. The American Judicial System, including BOLI & the EEOC is unable to insure W/M workers Civil Rights, and it is highly unlikely that the system will become impervious anytime soon to the undue influence that W/M's vast resources wield. The disadvantaged W/M workers in defense of their Civil Rights don't stand a chance going up against W/M's vast financial resources, and its powerful influence. Whether its the unknown David vs Goliath civil rights case of disabled Kevin Hayes vs Wal-Mart in Oregon that is currently on life support in the 9th Circuit Court of Appeals, or the well known civil rights case of Betty Dukes vs Wal-Mart, in California in which the US Supreme Crt denied class action certification to the 1.6 million female W/M workers across the nation seeking justice. A number equivalent to over 1/2 of W/M's workforce. Dukes was then denied certification by the US Dist.Court for the North Dist. of CA for a class action of 6 female CA W/M workers. What's happening with both Hayes & Dukes cases provide undeniable evidence that where it involves Wal-Mart our judicial system cannot protect nor guarantee the civil rights of the W/M workers.
UNITED, WE THE PEOPLE, the Court of Public opinion can do what our Courts of Law can not. After all, the only court that matters to Wal-Mart, is the court of Public opinion. That's because the source of W/M's power is within the pocketbooks of the Public. The Public's pocketbooks are controlled by perception. W/M is a master of spin, and false perception. The Public needs to be aware of the injustice that is being done with the money they spend & invest with W/M. The truth is coming out. Ethical individuals are starting to say NO to Wal-Mart's Civil Rights Rollback. Just last week, in unprecedented support of the civil rights of W/M workers, the City of Portland, Oregon announced that it is divesting from W/M bonds investments. More ethical actions like that, and like signing this petition are needed to send a powerful and necessary mandate to W/M. Act ethically to support the mandate & movement to put an end to W/M's rollback on civil rights. W/M will not change without our help. United we can make a difference. Why is this important?
Under the direction of former CEO H. Lee Scott, W/M initiated a systematic rollback of its workers civil rights. Evidenced prior to 2004, & fueled by W/M's vast economic resources, it's still going strong today, & needs to be stopped
What happened to Kevin Hayes, & what's continuing to happen to countless others in the W/M workplace is unfair & unjust. These are not isolated incidences. Nor are the workers simply disgruntled as W/M would have you believe. W/M workers like Hayes are victims of an unconstrained civil rights tyrant committed to fighting the civil rights of its workers to the bitter end. Racism, anti-Semitism, Discrimination, Harassment, Retaliation, Threats of Violence, Intimidation, Bullying, and working in a hostile & unsafe work environment should never be made a condition of employment. Nor should anyone fear for their safety in the workplace or community. Nor should one's coworkers be lied to, & socialized into accepting & participating in illegal behavior. Nor should anyone ever be terminated for simply refusing to accept the illegal behavior as a condition of employment. Nor should one's final pay be withheld. Nor should anyone have to run the civil rights gauntlet for years simply because Wal-Mart is incapable of acting ethically. Hayes experienced that & much more. He tried for 3+ years to get W/M to stop the rollback on his civil rights. Hayes is still litigating today, and in Courts that refuse to make W/M even obey the Courts rules
Hayes has Cushings, a rare autoimmune disorder that creates a continual surplus of cortisol in his body causing morbid obesity, pain & weakness in the extremities, high blood pressure, and a myriad of other disabling conditions including diabetes, all of which Hayes suffers with. All are ADA protected disabilities. Hayes was first diagnosed & treated at the age of 10. The course of treatment proved insufficient, the Cushings returned & Hayes was unable to prevent the resulting devastating disabling morbid obesity or his other disabling conditions. The Cushings was subsequently verified by 2 specialists in endocrinology, Dr Stephen Zielinski, who made repeated unsuccessful attempts to get W/M to accomodate Hayes disabilities, and then by board certified endocrinologist, Dr James Neifing. The full battery of laboratory tests, standard & necessary to ensure proper diagnosis of Cushings were conducted.
Hayes was hired as an Unloader in 2004, at the W/M Distribution Center #6037 in Hermiston, OR. Hayes desperately needed the W/M job in order to provide for himself, & his seriously ill, disabled mother. Hayes disabling morbid obesity was deemed unacceptable by Wal-Mart, as was his Jewish Race & Religion. W/M Mgmt were overheard discussing the intent to make Hayes, "sweat some of his fat ass off" by denying Hayes the use of the power equipment needed to do the job. Disabled Hayes was subjected to continual humiliation, ridicule, degradation as he struggled to manually unload the freight from the trailers, under production standards that were unattainable by able bodied individuals using power equipment. Hayes was continually refused the use of power equipment as reasonable accommodation. W/M Mgmt socialized Hayes co-workers into finding the discriminatory treatment of Hayes acceptable, and garnered participation by lying to them & claiming that Hayes was not disabled, & was just wanting special treatment. Additionally, W/M Mgmt incited, condoned & participated in anti-Semitism towards Hayes utilizing the same socialization process. As such, Hayes civil rights were continuously violated thru out the duration of his employment with blatant disregard for W/M's alleged policies, procedures, standards & core belief of "respect the individual". Over 20 DC Mgmt participated in the illegal behavior & in the collusion to cover it up. W/M's CEO H. Lee Scott & members of WM Corp Mgmt including W/M's Corporate Investigations, Global Ethics Dept, Human Resources, Personnel, Legal & ADA Services either participated in the cover up, and/or did nothing to put a stop to it & protect Hayes civil rights. There's evidence, including but not limited to the following: W/M not conducting fair, impartial, thorough or complete investigations. Individuals allowed to investigate themselves, the same as in W/M's Mexico Bribery Scandal. WM's HR entertaining itself by investigating Santa's religion, rather than Hayes complaints. W/M's HR Mgr interjecting unwarranted comments regarding Hayes Jewish Race & Religion into his Workers Comp. Claim. A W/M Operations Mgr encouraging workplace violence towards Hayes; discussing with co-workers taking Hayes out with a rifle. At any other company in America they'd be terminated, but at W/M they're rewarded, promoted & protected. W/M hired attorneys who like W/M acted unethically.
